On this page, FORZA TRANSPORTATION SERVICES, INC. (“THE COMPANY”) provides information for California residents, as required under the California Consumer Privacy Act (“CCPA”). The CCPA requires that THE COMPANY disclose how it handles California residents’ personal information, whether collected online or offline. Under the CCPA, “personal information” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. THE COMPANY specializes in providing Full Truck Load. Transportation Service between the NAFTA countries of Canada, Mexico and the United States, facilitating industries like the food services, automotive and mass consumption among others to take place.

Below, THE COMPANY provides the general categories of personal information (as defined by the CCPA) that it may collect. THE COMPANY´s collection, use and disclosure of personal information about a California resident will vary depending upon the circumstances and nature of our interactions or relationship with such resident. These categories may include:

• Name, Contact information and other identifiers.
• Customer records such as interactions with the app and time of use.
• Usage data.
• Audio, video and other electronic data.

How We Collect Personal Information:

THE COMPANY collects personal information automatically through the use of technologies and other similar tools during the interaction of users with the app.

Such information is processed to improve the quality of our services and optimize the user experience, in compliance with the applicable legal provisions on the protection of personal data.

As a California resident, California law grants you certain rights and imposes restrictions on particular business practices as described below.

Sale of Personal Information. THE COMPANY does not sell personal information.

Some California residents may have the right to make the following requests at no charge to them:

Request to Delete: California residents have the right to request deletion of their personal information that THE COMPANY collected about them and to have such personal information deleted to the extent allowed under law. The CCPA prohibits discrimination against California residents for exercising their rights under the CCPA. Such information is processed to improve the quality of our services and optimize the user experience, in compliance with the applicable legal provisions on the protection of personal data.

3. Security of personal data.

THE COMPANY will implement security measures, technical, administrative and physical, necessary to protect your personal data and prevent damage, loss, alteration, destruction or unauthorized use, access or treatment. Only authorized personnel, who have complied and observed the corresponding confidentiality requirements, may participate in the processing of your personal data. Authorized personnel are prohibited from allowing access by unauthorized persons and from using your personal data for purposes other than those set forth in this Privacy Notice. The obligation of confidentiality of the people who participate in the processing of your personal data subsists even after the termination of the relationship with THE COMPANY. The stored data is securely stored in THE COMPANY’s own servers.

As part of its own business operations and in order to fulfill the purposes described above, THE COMPANY may share with third parties, domestic or foreign, some or all of your personal data. Such third parties may be affiliated or subsidiary companies of THE COMPANY; external professional advisors and/or external suppliers.

THE COMPANY will ensure that such third parties maintain adequate security, administrative, technical and physical measures to safeguard your personal data, as well as that such third parties only use your personal data for the purposes for which they were hired and in accordance with this Privacy Notice.

THE COMPANY will not assign, sell or transfer your personal data to third parties not related to THE COMPANY, without your prior consent. However, THE COMPANY may transfer your personal data in the cases provided for in the Law.

The personal data we collect is stored securely in THE COMPANY’s own services, which have physical, administrative and technological security measures to ensure its integrity and confidentiality. THE COMPANY is committed to safeguard the information in its own servers and systems, under strict access and protection policies, to prevent its loss, misuse or unauthorized access.

In the event that THE OWNER wishes to object to the processing of his/her personal data for the purposes set forth in this paragraph, by means of a communication sent to the e-mail address mentioned at the beginning of this Privacy Notice. THE OWNER may request that THE COMPANY not to share or transfer his/her personal data.

5. User permissions.

For the use of some functionalities of the application it is necessary that You grant access permissions, for example camera and/or photos, as well as geolocation of the mobile device and to the vibrator module of the mobile device. You can disable or adjust permissions by following the procedures and settings of the mobile device, however, this may limit the use of some features.

6. Rights to which you are entitled.

You may exercise your privacy rights in accordance with applicable laws by completing our inquiry form at the following link _________. You are entitled to various privacy rights, subject to applicable law, with respect to the personal data we process about you, including but not limited to the following rights:

• Opt-out of the use or sharing of your personal information: You have the right to object to the use of your personal data for specific purposes.

• Delete personal information: You have the right to request the deletion of your personal data from our records or databases when you believe it is no longer being used properly.

• Change or correct personal information: You have the right to request the correction of your personal data if it is outdated, inaccurate, or incomplete.
• Revoke the use of personal information: You may request that we stop using all or part of your information or that we limit its use.

We inform you that our application does not use cookies through which your behavior as a user can be monitored.

The personal data collected is securely stored on servers owned by THE COMPANY, located in Laredo, Texas. THE COMPANY is committed to implementing the necessary technical and organizational measures to protect the security, integrity, and confidentiality of the information stored, in accordance with applicable data protection laws and regulations.

This Privacy Notice may be modified, changed, or updated due to new legal requirements, our own needs concerning the products or services we offer, our practices, or changes in our business model

• Dar cumplimiento a la legislación aplicable en la República Mexicana, así como a nuestras políticas internas y/o algún requerimiento de cualquier autoridad;

En caso de que sus datos personales pretendan ser utilizados para una finalidad distinta a lo mencionando con anterioridad, LA EMPRESA le notificara por correo electrónico o por teléfono, a fin de obtener su consentimiento para el tratamiento de sus datos personales de acuerdo con las nuevas finalidades. De no recibir su consentimiento, para los casos en que es necesario LA EMPRESA no utilizara sus datos personales.

Al proporcionar datos personales de un tercero, se considera que usted ha informado al tercero sobre dicha situación y que cuenta con el consentimiento para la utilización de sus datos personales, así como estos han aceptado el presente Aviso de Privacidad.

Los datos que recopila LA EMPRESA son obtenidos de forma automática mediante el uso de tecnologías y otras herramientas similares durante la interacción de los usuarios con la aplicación. Dicha información es procesada con el fin de mejorar la calidad de nuestros servicios y optimizar la experiencia del usuario, en cumplimiento con las disposiciones legales aplicables en materia de protección de datos personales.

Es menester informarle que los datos recopilados por LA EMPRESA son almacenados en servidores ubicados en Laredo, Texas los cuales forman parte del patrimonio de la misma.

3. Seguridad de los datos personales.

LA EMPRESA implementará las medidas de seguridad, técnicas, administrativas y físicas, necesarias para proteger sus datos personales y evitar su daño, pérdida, alteración, destrucción o el uso, acceso o tratamiento no autorizado. Únicamente el personal autorizado, que ha cumplido y observado los correspondientes requisitos de confidencialidad, podrá participar en el tratamiento de sus datos personales. El personal autorizado tiene prohibido permitir el acceso de personas no autorizadas y utilizar sus datos personales para fines distintos a los establecidos en el presente Aviso de Privacidad. La obligación de confidencialidad de las personas que participan en el tratamiento de sus datos personales subsiste aun después de terminada la relación con LA EMPRESA. Los datos almacenados son resguardados de forma segura en los servidores propios de LA EMPRESA.

4. Comunicaciones y transferencia de datos personales con terceros.

Como parte de las operaciones propias del negocio y a fin de cumplir con las finalidades descritas; LA EMPRESA podrá compartir con terceros, nacionales o extranjeros, algunos o todos sus datos personales. Dichos terceros podrán ser compañías afiliadas o subsidiarias de LA EMPRESA; asesores profesionales externos y/o proveedores externos. 

LA EMPRESA procurará que dichos terceros mantengan medidas de seguridad, administrativas, técnicas y físicas adecuadas para resguardar sus datos personales, así como que dichos terceros únicamente utilicen sus datos personales para las finalidades para las cuales fueron contratados y de conformidad con el presente Aviso de Privacidad.

LA EMPRESA no cederá, venderá o transferirá sus datos personales, a terceros no relacionados con “LA EMPRESA”, sin su consentimiento previo. Sin embargo, LA EMPRESA podrá transferir sus datos personales en los casos previstos en la Ley.

Los datos personales que recopilamos son almacenados de manera segura en los servicios propios de “LA EMPRESA”, que cuentan con medidas de seguridad físicas, administrativas y tecnológicas para garantizar su integridad y confidencialidad. “LA EMPRESA” se compromete a resguardar la información en servidores y sistemas propios, bajo estrictas políticas de acceso y protección, para prevenir su pérdida, uso indebido o acceso no autorizado.

En caso de que EL TITULAR desee oponerse al tratamiento de sus datos personales para las finalidades previstas en este párrafo, mediante comunicado enviando al correo electrónico que se menciona al principio del presente Aviso de Privacidad. El TITULAR podrá solicitar que LA EMPRESA que no se compartan o cedan sus datos personales.

5. Permisos del usuario.

Para el uso de algunas funcionalidades de la aplicación es necesario que Usted otorgue permisos de acceso, por ejemplo, cámara y/o fotografías, así como geolocalización del dispositivo móvil y al módulo de vibrador del dispositivo móvil. Usted puede deshabilitar o ajustar los permisos siguiendo los procedimientos y configuraciones del dispositivo móvil, sin embargo, esto podría limitar el uso de algunas funcionalidades.

6. Derechos que le corresponden.

Puede ejercer sus derechos de privacidad de acuerdo con las leyes aplicables, completando nuestro formulario de consulta en la siguiente liga ____________. Usted tiene múltiples derechos de privacidad, sujetos a la legislación aplicable, con respecto a la información que procesamos sobre Usted, dentro de los cuales destacan los siguientes:

Sin embargo, es importante que tenga en cuenta que no en todos los casos podemos atender su solicitud o concluir el uso de manera inmediata, ya que es posible que por alguna obligación legal requiramos seguir tratando sus datos personales. Asimismo, usted deberá considerar que, para ciertos fines, la revocación de su consentimiento implicaría que no le podamos seguir prestando el servicio o la atención que nos solicitó, o la conclusión de su relación con nosotros.

Los datos personales que se recopilan son almacenados de manera segura en servidores propiedad de LA EMPRESA, ubicados en Laredo, Texas. LA EMPRESA se compromete a implementar las medidas técnicas y organizativas necesarias para proteger la seguridad, integridad y confidencialidad de la información que almacena, conforme a las leyes y regulaciones aplicables en materia de protección de datos.

El presente Aviso de Privacidad puede sufrir modificaciones, cambios o actualizaciones derivadas de nuevos requerimientos legales; de nuestras propias necesidades por los productos o servicios que ofrecemos; de nuestras practicas; o de cambios en nuestro modelo de negocio.
