CALIFORNIA CONSUMER RIGHTS SECTION

On this page, FORZA TRANSPORTATION SERVICES, INC. (“THE COMPANY”) provides information for California residents, as required under the California Consumer Privacy Act (“CCPA”). The CCPA requires that THE COMPANY disclose how it handles California residents’ personal information, whether collected online or offline. Under the CCPA, “personal information” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. It does not include publicly available information, which is any information lawfully made available by a state, local, or federal government source.

THE COMPANY specializes in providing Full Truck Load. Transportation Service between the NAFTA countries of Canada, Mexico and the United States, facilitating industries like the food services, automotive and mass consumption among others to take place.

Below, THE COMPANY provides the general categories of personal information (as defined by the CCPA) that it may collect. THE COMPANY´s collection, use and disclosure of personal information about a California resident will vary depending upon the circumstances and nature of our interactions or relationship with such resident. These categories may include:

  • Name, Contact information and other identifiers.
  • Customer records such as interactions with the app and time of use.
  • Usage data.
  • Audio, video and other electronic data.

How We Collect Personal Information:

THE COMPANY collects personal information automatically through the use of technologies and other similar tools during the interaction of users with the app.

Purpose for collecting personal information:

Such information is processed to improve the quality of our services and optimize the user experience, in compliance with the applicable legal provisions on the protection of personal data.

California resident´s rights.

As a California resident, California law grants you certain rights and imposes restrictions on particular business practices as described below.

Sale of Personal Information. THE COMPANY does not sell personal information.

Some California residents may have the right to make the following requests at no charge to them:

Request to Delete: California residents have the right to request deletion of their personal information that THE COMPANY collected about them and to have such personal information deleted to the extent allowed under law. Please note that THE COMPANY is required to keep certain data pursuant to the law.

Request to Know: California residents have the right to request, and subject to certain exemptions, receive a copy of the specific pieces and categories of personal information, as defined by CCPA, that THE COMPANY has collected about them in the prior 12 months and to have this delivered, free of charge, either (a) by mail or (b) electronically in a portable and, to the extent technically feasible, readily useable format that allows the individual to transmit this information to another entity without hindrance. The CCPA prohibits discrimination against California residents for exercising their rights under the CCPA. Discrimination may exist where a business denies or provides a different level or quality of goods or services, or charges (or suggests that it will charge) different prices, rates, or penalties on residents who exercise their CCPA rights, unless doing so is reasonably related to the value provided to the business by the residents’ data.

THE COMPANY will implement security measures, technical, administrative and physical, necessary to protect your personal data and prevent damage, loss, alteration, destruction or unauthorized use, access or treatment. Only authorized personnel, who have complied and observed the corresponding confidentiality requirements, may participate in the processing of your personal data. Authorized personnel are prohibited from allowing access by unauthorized persons and from using your personal data for purposes other than those set forth in this Privacy Notice. THE COMPANY will not assign, sell or transfer your personal data to third parties not related to THE COMPANY, without your prior consent. However, THE COMPANY may transfer your personal data in the cases provided for in the Law.

The personal data we collect is stored securely in THE COMPANY’s own services, which have physical, administrative and technological security measures to ensure its integrity and confidentiality. THE COMPANY is committed to safeguard the information in its own servers and systems, under strict access and protection policies, to prevent its loss, misuse or unauthorized access.

In the event that THE OWNER wishes to object to the processing of his/her personal data for the purposes set forth in this paragraph, by means of a communication sent to the e-mail address mentioned at the beginning of this Privacy Notice. THE OWNER may request that THE COMPANY not to share or transfer his/her personal data.

For the use of some functionalities of the application it is necessary that You grant access permissions, for example camera and/or photos, as well as geolocation of the mobile device and to the vibrator module of the mobile device. Es menester informarle que los datos recopilados por LA EMPRESA son almacenados en servidores ubicados en Laredo, Texas los cuales forman parte del patrimonio de la misma.

 

  1. Seguridad de los datos personales.

 

LA EMPRESA implementará las medidas de seguridad, técnicas, administrativas y físicas, necesarias para proteger sus datos personales y evitar su daño, pérdida, alteración, destrucción o el uso, acceso o tratamiento no autorizado. Únicamente el personal autorizado, que ha cumplido y observado los correspondientes requisitos de confidencialidad, podrá participar en el tratamiento de sus datos personales. Usted puede deshabilitar o ajustar los permisos siguiendo los procedimientos y configuraciones del dispositivo móvil, sin embargo, esto podría limitar el uso de algunas funcionalidades.

De manera reciente, Forza Transportation Services dio a conocer que incorporó sus primeros tractocamiones eléctricos, el Kenworth T680E, que de acuerdo con la información compartida a T21, es el primero de su clase en esta región de Texas, y que estará operando para el intercambio comercial entre México y Estados Unidos.

“Los camiones eléctricos se han convertido en una herramienta crucial en nuestra industria, ya que cada vez más clientes exigen soluciones que no impacten negativamente el medio ambiente, como lo hace el diésel”, comentó Roberto Pérez, CEO de Forza.

Con base en los datos del Departamento de Comercio de los Estados Unidos, México se mantiene como el principal socio comercial de este país, y el puerto de Laredo es le más importante para el comercio exterior de la Unión Americana, en el primer semestre del 2024 el valor del comercio alcanzó 166 mil millones de dólares (mdd).
